Terms of Service

These terms govern access to LocalWebDesk, orders for website services, subscriptions, and use of the website management platform. By creating an account or purchasing a service, you agree to these terms.

Eligibility and authority

You must be legally able to enter into a binding agreement. If you use LocalWebDesk for a company or other organisation, you confirm that you are authorised to accept these terms for that organisation.

Our service

LocalWebDesk provides professionally built websites and supporting tools for small businesses. Services may include design and setup, responsive pages, content management, hosting, domains, forms, SEO settings, image storage, website publishing, billing, and customer support.

The features, deliverables, price, and expected timing for a particular project are those shown at checkout or confirmed in writing. Features not included in the agreed scope may require a separate quote or future product plan.

Accounts and access

You must provide accurate information, keep your password and email account secure, and tell us promptly about suspected unauthorised access. You are responsible for activity performed through your account unless caused by our failure to use reasonable security measures.

Business owners may authorise team members. Each user should use their own account. You are responsible for removing access when a team member no longer requires it.

Website production and revisions

You agree to provide the content, images, approvals, and business details reasonably needed to complete your website. Delays in receiving this information may delay delivery.

We revise the design until you are satisfied within the scope of the service you purchased. This does not include unlimited new pages, rebranding, custom software, or a replacement project unless agreed separately. A website is treated as approved when you approve it in the platform or instruct us to publish it.

Your responsibilities

You are responsible for the accuracy and legality of your business information, services, claims, prices, policies, and website content. You must obtain permission to use uploaded logos, photographs, trademarks, testimonials, and other materials.

  • Do not use LocalWebDesk for unlawful, fraudulent, deceptive, defamatory, abusive, or harmful activity.
  • Do not upload malware, attempt unauthorised access, interfere with the platform, or bypass security controls.
  • Do not collect sensitive information through ordinary contact forms when a specialist compliant system is required.
  • Maintain any licences, disclosures, privacy notices, and industry-specific terms required for your business.

Fees, checkout, and taxes

Prices, billing frequency, currency, and included services are shown before checkout. A website setup fee is a one-time charge and a platform subscription is recurring unless the checkout or order confirmation says otherwise. Stripe processes payment details on our behalf.

You authorise recurring charges for the subscription you select. You are responsible for applicable taxes, duties, and bank or currency-conversion fees unless they are expressly included. Mandatory consumer rights continue to apply and are not excluded by these terms.

Subscriptions and cancellation

Subscriptions renew automatically for each billing period until cancelled. You may request cancellation through your account or by contacting us. Unless the order confirmation states otherwise, cancellation takes effect at the end of the paid billing period and does not automatically refund charges already incurred.

If payment fails, we may retry the payment, ask you to update your payment method, limit paid features, or suspend publishing after reasonable notice. We will not rely only on a checkout success page when recording payment status; verified payment-provider events control billing status.

Domains and third-party services

Domain registration, DNS, maps, reviews, email, payment processing, and other connected services may be provided by third parties. Their availability, rules, and fees may change. You must follow their terms and maintain any account or information they require.

We will provide reasonable assistance with domain connection, but cannot guarantee the availability of a requested domain or control delays caused by registrars, DNS propagation, search engines, or third-party platforms.

Content ownership and licence

You retain ownership of original content you provide. You grant LocalWebDesk a non-exclusive licence to host, copy, resize, adapt, display, transmit, and back up that content as necessary to provide and support your website.

LocalWebDesk retains ownership of its software, administration platform, reusable components, templates, processes, documentation, and underlying systems. Purchasing a website service does not transfer ownership of the LocalWebDesk platform or reusable technology.

Feedback and portfolio use

You may send ideas or feedback about the platform. We may use general feedback without an obligation to compensate you, but we will not claim ownership of your confidential business information.

We will not present your business as a customer case study or use private materials in marketing without permission. Publicly accessible website pages may be linked to or shown as examples only where we have permission or another lawful basis.

Availability, backups, and changes

We aim to provide a reliable service, but maintenance, security incidents, internet failures, provider outages, and events outside our control may interrupt access. You should keep copies of important source content and business records.

We may update the platform to improve security, performance, or usability. If a material change significantly reduces a paid service, we will provide reasonable notice where practical.

Suspension and termination

We may suspend or terminate access where payment remains overdue, use creates a security risk, content is unlawful, these terms are materially breached, or suspension is required by law. Where reasonable, we will notify you and give you an opportunity to fix the issue.

When service ends, public hosting and platform access may stop. Contact us promptly if you need an export of available customer-provided content. Some records may be retained for billing, security, backup, dispute, or legal purposes.

Disclaimers

We provide professional website services with reasonable care and skill. We do not guarantee a particular search ranking, number of enquiries, revenue result, uninterrupted availability, or approval by a third-party platform. SEO outcomes and business results depend on factors outside our control.

Nothing in these terms excludes warranties, guarantees, or remedies that cannot lawfully be excluded.

Liability

To the extent permitted by law, LocalWebDesk is not liable for indirect, incidental, special, or consequential loss, loss of profit, loss caused by inaccurate customer content, or a third-party service failure outside our reasonable control.

Any limitation will apply only to the extent legally permitted and will not limit liability that cannot be limited under applicable law. Contact us promptly about a problem so we have a reasonable opportunity to investigate and reduce its impact.

Changes and general terms

We may update these terms as the service changes. The revised terms will be published here with a new date. Material changes affecting an active paid service will be communicated where reasonably possible.

If part of these terms is unenforceable, the remaining terms continue. A delay in enforcing a term is not a waiver. These terms, together with your checkout and written project confirmation, form the agreement for the service.
